January 8, 2024—Partner Nick Groombridge discussed developments in the law governing damages in trade secret cases at The New York City Bar’s Trade Secrets Symposium in New York City on December 12, 2023. Alongside fellow panelists, Victoria Cundliff, Trade Secret and IP Professor at UPenn’s Carey Law School and Dawn Hall, Senior Managing Director at FTI Consulting, Nick spoke about the decision in Syntel v TriZetto, a case he handled, in which the Second Circuit addressed when so-called avoided costs are and are not available as a measure of damages. The Second Circuit’s decision has been described as a major development of remedies law under the federal Defend Trade Secrets Act.
